TERMS AND CONDITIONS OF SALE: As stated by Wacnet Ltd. (CD-EXPRESS). Once a payment has been paid these terms are activated. (b) An order once placed cannot be cancelled except by mutual agreement & then only on terms that would fully indemnify CD-EXPRESS. That is to say that this is an authorized legitimate contract and will be acknowledged by The Buyer by means of the (i) Submission of an Official Purchase Order (ii) Acknowledgement via Internet, facsimile or written hard copy on letter headed paper from The Buyer. (iii) By means of any payment in relation to CD-EXPRESS (Wacnet or The ISDN Bureau) by The Buyer (iv) Receipt of any payment in relation to the Invoice number or Tracking Number. All the above acts will commit The Buyer to the acceptance of these terms and conditions of this contract.

  1. Wacnet.net and CD-Express are part of Wacnet Ltd (Worldwide Artwork Communications Network). Wacnet will deliver your document on CD Rom to the address, which has been stated on the original booking online from the Internet.
  2. FORCE MAJEURE: Wacnet.net are receiving 100's of transmissions per hour, and with our own team of couriers we will ensure that your artwork file (on CD-ROM and print outs if applicable) are delivered within 4-6 business local working hours to Hong Kong and 12 working hours to the rest of Asia, from receipt. Should CD-EXPRESS be delayed in or prevented from making delivery owing to act of god, civil disturbance, requisitioning government or parliamentary restrictions, prohibitions or enactment of any kind, import or export regulations, strike, lock-out, trade dispute, difficulty in obtaining workman or materials, breakdown of machinery, fire, accident or other cause whatsoever beyond CD-EXPRESS's control, CD-EXPRESS shall be at the liberty to cancel or suspend the contract without incurring any liability to any loss or damage resulting there from.
  3. COST: The Cost of the service is subject to the amount of credits you purchase in advance. Credit is not given unless otherwise agreed.
  4. COMPRESSION: All files must be compressed. You can send up to 500MB at one time so the more you compress your files the more you can send. We recommend that you use the following programs for comprssion:

  1. CONFIDENTIAL: All files remain confidential. No one will see your files other than the intended parties. You have the option to 'Lock' the file with your own Password (from within "Stuffit" or "Winzip"), which will be done independently prior to it going onto the Wacnet Gateway. You would need to e-mail this password to the recipient independently so that they can open the file. The downloaded files are dealt with by a computerized sorting office, then each file, which is copied onto CD-ROM, is labeled with your tracking number. They are then transported to the requested destination; you will receive confirmation from the recipient once the file is delivered.
  2. FIREWALL: Wacnet reserve the right to not accept files, which are not compressed. This is due to the security firewall, which protects us from virus upload.
  3. PASSWORD: To Ensure the security of the Wacnet Service you will be responsible for your own passwords. We suggest that you take note of the password and guard it safely. If you should loose your password you can obtain it online by submitting your email address and the password will be sent back to that email only.
  4. TRACKING NUMBER. Your file will not be forwarded to the destination without the seven-digit tracking reference. If a file is sent from you without the correct code, Wacnet in Asia will have no way of knowing where the file is to be sent. All the details, which you have entered, will be recorded and copied to the Wacnet bureaus in Hong Kong and Asia. This information is used for the delivery to be successful.
  5. FILE SIZE: You can send as many files or jobs as you like so long as they are no more than 500MB in total, and so long as they are all going to the same address. If you would like to send a file or job to a different address then you will have to initiate another Wacnet seven-digit tracking reference in order to transmit the document to the correct destination. Anything over this size CD-EXPRESS reserves the right to refuse transmission. If you would like to transmit more than the said 500MB please consult your account handler prior to booking.
  6. FILE CRASHES DURING TRANSMISSION: This is something, which is sometimes unavoidable. We suggest that you compress the files as much as possible so that you are on line for the minimum length of time. If you think that the file is crashing due to the file being too large we advise that you send it in two or three parts (no more than 150MB each).   7. TRACKING: We have a fully automated tracking system. From your members page you can access the Administration area of the site to track all your deliveries. In addition, you will receive an automatic e-mail when your CD-ROM has been delivered to the destination.
  8. COMPUTER FORMAT: Wacnet has both Mac and PC facility for download of files. Again we recommend that you compress all your artwork to reduce your cost and time in transit. We also recommend that you save files in Adobe Illustrator, Adobe Photoshop, EPS or Freehand format. We advise you not to use Quark Xpress as this application can sometimes conflict with Hong Kong and other Asian Manufacturers. Please check with your manufacturer before sending Quark Xpress.
  9. DISCOUNTS: Discounts for regular Wacnet users. If you are using the Wacnet service on a regular basis, we like to offer our customers a credit system where you can buy from 10 to 100 credits in advance. These credits can be used either by your own company or your client so that they can send it directly from their premises.
    All documents transmitted via the Wacnet Operating System are 100% confidential. All Files must be compressed and any special instructions should be consulted with your account handlers. Any Special conditions must be dealt with in writing and acknowledged by both parties.
  10. DELIVERY: CD-EXPRESS will not be responsible for any failure to fulfill any terms of this agreement if fulfilment has been delayed, hindered or prevented by any circumstance whatsoever, which is not in the control of CD-EXPRESS or by shortage of supplies required for or in connection with the manufacture of the goods or by compliance with any order or request of any national, port, local or any other person to deliver at that time, CD-EXPRESS shall be at liberty to withhold, suspend overdue delivery to such an extent as CD-EXPRESS in its discretion may think fit. If you wish your order to be represented to the delivery address for a second time CD-EXPRESS will tack that as an additional charge and deduct, specifications of boxes etc must be provided by the Buyer and this will be charge at an additional cost.
  11. GUARANTEE: CD-EXPRESS hereby guarantees that the CD ROMs will be 100% confidential and will only be delivered to the address stated by the buyer. If the buyer requests that the files are un-compressed prior to delivery they must email the instructions to deliveries@wacnet.net as soon as the upload has been made using the tracing number of the job.
  12. PRICE VARIATION: CD-EXPRESS reserves the right by written notice any time, to vary the price of the transmission to take account of any increases in the cost of raw materials, manufacture, packing transport or wages. Whilst every effort is made to keep to the delivery cost as low as possible, we can not be responsible for fluctuation in exchange control rates make it impossible to guarantee forward prices.
  13. NOTICE OF DAMAGE OR NON-DELIVERY: Signatures given for goods damaged or late deliveries must be qualified by a remark to that effect. No claims for damage or late delivery can be entertained unless notified to CD-EXPRESS within 6 hours and confirmed in writing within 48 hours. Claims for non-delivery must be notified to CD-EXPRESS in writing within 24 hour of delivery date.
  14. DELIVERIES: Once a delivery has been made and the recipient is unable to open the CD Rom, they have the option to contact their local Wacnet Bureau for the delivery of the existing transmission to be delivered again. If the problem with opening the files on the CD Rom are flexible to change Wacnet reserve the right to charge for this additional delivery and a credit will be removed from your account further to notification to the buyer.
  15. PRINT OUTS: The print outs which are delivered with the CD Rom when applicable are for reference quality only and are not colour proofs. A maximum of three print out can be delivered at no extra cost to the buyer unless otherwise agreed. If the buyer requires more than 3 printout then a credits will be deducted from their account online for every additional 10 print outs made in a month
  16. RESPONSIBILITY: Wacnet accepts no responsibility for the contents of files, which are sent via the Wacnet operation system. The sender is responsible for all copyright and such like.
